RE: The tariff classification of an illuminated sign from China

Dear Mr. Bahramian:

In your letter dated January 21, 2015, you requested a tariff classification ruling. Representative sample was submitted with your letter and will be returned to you.

The article is identified as Part #26.2, an illuminated sign that does not contain the actual numbers or words. The sign consists of an aluminum frame with an acrylic backing and an acrylic clear cover. The edges are comprised of a Plexiglas diffusing sheet, LED strips and a permanently affixed light source forming an illuminating surface. The sign measures approximately 12 inches wide by 7.5 inches high by 1.3 inch deep. It is stated that the sign is used in the construction of light panels, for the manufacturing of different sizes of house numbers or illuminated signs, per customers’ specification.

The applicable subheading for Part #26.2, will be 9405.60.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Illuminated signs, illuminated nameplates and the like: Other.” The general rate of duty will be 5.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
